When Does a Motor Vehicle Accident Become a Legal Matter?
When someone else is at fault for the accident, the crash can become a legal issue. This is true whether the case involves accident injuries or wrongful death.
Furthermore, victims of car accidents often go through hardship, spending time in the hospital and missing days at work. In fact, the expense to cover the cost of medical care and lost wages can be devastating. However, when through negligence, another driver causes the accident, and your injuries are serious, you have the legal right to recover compensation for damages.
Proving another driver was at fault may require investigation to discover evidence. In the above delivery truck accident, investigation would be necessary to discern whether wrongful death occurred. For example, if the truck crash resulted from mechanical failure due to lack of proper vehicle maintenance, there may be grounds for a lawsuit. If the delivery company owned the truck and was responsible for maintenance, they could be party to a lawsuit. If a manufacturing defect made the vehicle unsafe, causing a crash, this factor also might provide a legal basis to sue the manufacturer for damages.
However, many accidents result from the driver’s own human error. Driving while tired, while texting or intoxicated are examples of human error. Accidents caused by the driver’s own human error do not provide grounds for lawsuits.
